International Debt Collection and Recovery

In the case of foreign debt collection, we try to enforce the financial claim for our client abroad, i.e. collect the debt from a foreign debtor, either through our local debt collection partner in the foreign country.

Foreign debt recovery is more complex than domestic debt recovery because it involves several legal systems and the legal environment of the debtor’s country and the place where the debt is owed must be taken into account. The following steps are common in this type of recovery:

  1. Partner consultations and reminders: the first step is to send a friendly reminder to the foreign debtor, asking for the debt to be settled, if necessary through our TCM Group partner in the country.
  2. International legal proceedings. This usually requires the assistance of a local lawyer or an international law firm, who will take legal action within the legal framework of the country concerned.
  3. Court proceedings and enforcement: It is also possible to bring a court action abroad. International court proceedings can be complicated, especially if the debtor is subject to a different jurisdiction. Enforcement also varies, as enforcement rules differ from country to country.
  4. International conventions: When recovering a foreign claim, various international conventions, such as the Paris Convention or the European Union’s enforcement regulations, can help to ensure faster and more efficient recovery, as they regulate legal procedures between countries.
